There are indeed some other programs that do have separate license pricing based on commercial vs home use. PlayClaw is a major competitor and one of the top tier screen recorders right now and it also does this. If you monetize and you are making a profit is it really going to hurt you to pay a one...

I can't tell for sure based on your information, as you didn't really provide any, but I am betting you have pinned Action! to your taskbar (aka right click the application and select pin to taskbar) so that it shows up even when Action! is closed. In this picture you provided it has a box around it...

If you want to record 3 audio tracks while using Action! you will need to manually record one of your extra sources using something like Audacity. Yea, I was originally thinking it might be 4:4:4 as well. Hopefully someone will know for sure. Using YV24 might just have to be "close enough" for my export but I HATE moving videos between color spaces if I can avoid it.
