So something odd is going on with Action for me. When it's running in the background it makes my games lag intermittently. I've tried limiting Action to recording at 30 fps. I've tried running the game I play (FFXIV) limited to 60 fps and unlimited. Unlimited it will do 100 or so fps with Action run...

Please try removing or moving to another location all your video files from your video output folder. Once your video folder is empty please run Action! and see if it's still crashing. Same issue here. I tried the above approach and a few other things I could think of such as updating graphics card...

Maybe I should have sent them a bug report by email or something.
Well I still hope that someone that can fix this has a look and takes action... (Get it? action... Oh you people are no fun.)
