Issues with Action! Live!

I dont know if its just the beta version and I think im going to go back to the stable version to see if it has any diference, but anytime i try to livestream at 720p, 30 fps, at 1500 bitrate i get about 10 seconds before i get game crippling fps lag, like im talking 0-4 fps. tested with a custom setting as well as my stream to twitch, I live in Canada, British Columbia, and i have a xfx double d 7870 gpu, and an i5 3570k cpu 8gb ram, 3mb upload speed, I have streamed before using another program so i know its not a speed issue

Is that the FPS you get in game, or the FPS that you lose while recording?

not recording im streaming, and as i said it gives me game crippling lag, meaning my fps ingame goes 0-4 after about the 5-10 second mark of streaming, also i tested it on the last stable release rather then beta and same results but instead of it waiting 5-10 seconds it was instant.
