Action! doesn't work with Max Payne 3

Please fix this ASAP

When I start Max Payne 3 and running Action! in the background I always get " Max Payne 3 has stopped working" dialog box
When I start Max Payne 3 without Action! the game starts and works just fine.

This is the DVD version of the game not the steam version.
I have heard that Fraps and Action! works with the steam version of the game.

I didn't notice any problems, I have the DVD version of the game and I am running Action! v1.3.3.0

It works now after a new patch for Max Payne 3 was released.
