Action! Causing Directx errors/game crashing

Lately I've been getting game crashes with Action! While gaming on Battlefied 3, Battlefield 4 Beta, Grid 2 and Metro Last LIght.

I get this error and the game crashes: DirectX function "GetDeviceRemovedReason" failed with
DXGI_ERROR_DEVICE_HUNG: Device hung due to badly formed
commands.. GPU: "NVIDIA GeForce GTX 770 ", Driver: 33140

I've only had this problem since installing and running Action!, I'm using the Intel quick sync mp4 container at 1080p, 30FPS and recording to a separate HDD. Windows 8.1


In My event viewer this is the error I have received.

I have only had these errors and game crashes with Action! running.

I attached the report seeing as how big it is. I am running BETA drivers right now but also note that this happens with certified WHQL drivers as well.

Just wanted to post a quick update and say that I've found that running these games in windowed mode/borderless alleviates all stuttering while recording and during the recording playback. Strange.
