When I turn the HUD on in game recording mode it always get's recorded. Is there a way to stop this from happening?

Settings when in game attempting to record. Mind you that Do not record HUD in games and applications is ticked:

Are you sure that HUD is not just showing up in your Video Player? Maybe it's just Action! that is plugged into your video app.
