Action MP4 Nvidia NVENC not recording all audio!

So Ive just been trying to record some Dragon age at 60fps with Action, which works fine, however using the MP4 Nvidia NVENC file format makes me lose ALL Audio randomly in the video. Normally its half way through the clip. It looks as though when the recording finishes only have the audio gets processed into the recorded file.

I DO NOT get this issue recording in AVI but I'd like to record in 1080p 60fps using the MP4 Nvidia NVENC as its smaller file sizes and easier for me to edit. Also there is no sound AT ALL when watching the footage back in Windows Media Player. However when imported into Sony Vegas both split audio tracks (1 for game audio and 1 for my microphone) show up but then go dead / silent half way through the clip.

Any help?
