[Issue] Recording MIC makes video FPS become variable

OS: Windows 10
Video Card: NVIDIA GTX 640
Memory: 8GB
Monitor Resolution: 1920 x 1080P
Video Editor: Vegas 13 and Adobe CS6\CC
Game Problem: Battlefield 4
Video Type: MP4 with NVENC
So everytime I record in MP4\H264 with NVENC and I configure Action to record my MIC as well the output video is recorded with variable FPS which causes audio\video desync and stutter. Analysing the file with mediainfo, it reports that the FPS is variable and the maximum fps is 150 and minimum is 3.
If I don't enable the MIC recording the file is recorded with constant FPS of 60 and mediainfo shows that the FPS of the file is constants instead of variable, which is perfect.
Whats the reason for action to change from constant FPS to variable when I record my mic?
